Fiscal Impact/Change to Net County Cost:  There is no Net County Cost associated with this Agreement.  This Amendment was anticipated and included in the appropriations for Health Services budget.

Background:   Ryan White CARE Act funding provides access to ambulatory medical care, medical case management and emergency intervention for individuals living with HIV and/or AIDS. Specific care services include, but are not limited to, specialty outpatient medical diagnosis and treatment, skilled nursing intervention, medication access/management, and medically necessary nutrition intervention to include direct food purchases.

Funding is received by HHSA through an agreement with the County of Sacramento (fiscal agent for the Ryan White CARE Act Title I Federal funding) for the specific purpose of providing services as outlined above.

Compensation for Services:  Monthly itemized invoices submitted for allowable expenses are paid within forty-five (45) days of receipt and approval.

Contract Termination:  This Agreement may be cancelled under the following conditions:  (1) by the County pursuant to Article X - Fiscal Considerations in the event the County budget does not provide sufficient funding for this Agreement; or (2) by the County without cause upon seven (7) calendar days written notice.

Retroactive Term:  The original Agreement was approved by the Board on December 20, 2011, at which time it was noted that the term was set to expire December 31, 2011, and Public Health anticipated returning to the Board with this amendment pending confirmation of the Federal funding.

Upon confirmation of Federal funding availability through June 30, 2012, every effort was made to return to the Board as soon as reasonably possible with this amendment.

Reason for Recommendation:   Approval of this Agreement will maintain funding for the provision of critical and emergency medical care services to persons living with HIV and AIDS through contract with Sierra Foothills AIDS Foundation.

Action to be taken following Board approval:
1.      Chair to sign three (3) original Amendments to Agreement 108-095A-P-E2011.
2.      Board Clerk's Office to return two (2) signed Agreements to HHSA - Public Health.
3.      HHSA - Public Health to distribute documents as appropriate.
