Sheriff's Office recommending the Board considering the following:
1) Authorize the Auditor/Controller to create a Special Revenue Fund for CalMMET revenue received from the State Controller's Office for methamphetamine investigation purposes;
2) Authorize the Auditor/Controller to create a Special Revenue Fund for future revenue received from various counties for the provision of Custody services at the Sheriff's South Lake Tahoe and Placerville Jails; and
3) Authorize the Chair to sign a Budget Transfer transferring unspent CalMMET revenues received during Fiscal Year 2011/12 from contingency to the special revenue fund, as well as posting Fiscal Year 2012/13 CalMMET revenues to the special revenue fund

No Change to Net County Cost. Revenue received from CalMMET and other counties will be deposited in Special Revenue Funds and drawn down as needed.
Background
Beginning in 2008, the California Multi-Jurisdicational Methamphetamine Enforcement Task Force (CalMMET) funds were subgranted to the Sheriff's Office through Yolo County. The Sheriff's Office narcotics staff participated in this Task Force, and the grant funds were used to offset staffing and equipment costs.
In October 2011, as part of the Governor's re-alignment of program funds, it was decided that CalMMET funds would no longer function as a grant where an application and an official award had to be made. Instead, there is now a direct transfer of funds from the California State Controller's Office to the County. The County received $265,707 in funding in Fiscal Year 2011/12 and is budgeted to receive $266,623 in Fiscal Year 2012/13. These funds must be used to offset costs for salaries and equipment related to methamphetamine investigations. As a result, these funds should be placed in a Special Revenue Fund separate from the Sheriff's operating budget, and drawn down to offset authorized expenditures.
With regard to the creation of a Custody Special Revenue Fund, the Sheriff's Office is having discussions with a few other counties to develop Memoranda of Understanding (MOU) to house their inmates, which will generate revenue on an ongoing basis. The MOUs will be routed through County Counsel and the Board for approval. Recently, the Board approved an MOU with Shasta County for housing its inmates and the revenue will be deposited in this new Special Revenue Fund.
Reason for Recommendation
To create two Special Revenue Funds for deposit of CalMMET funds and Custody revenue from other counties for use over an extended period of time.
Action(s) to be taken following Board approval
Auditor will create two new Special Revenue Funds for the Sheriff's Office and the Chairman will sign the Budget Transfer. Revenue received will be deposited and drawn down as needed.
