Title: Chief Administrative Office recommending the Board conduct a public hearing and adopt Resolution 037-2013 to declare that the operation of a carnival at Town Center in El Dorado Hills by Butler Amusements, Inc. on March 21, 2013 through March 24, 2013 did not endanger the public health, safety and welfare, and that such operation did not violate any zoning or health laws or regulations. Reason for Recommendation
County Ordinance Code section 5.12.050 of Title 5 (known as the county business license ordinance) requires the operator of a carnival to obtain a business license. In order to obtain the business license, the ordinance requires a resolution of the Board of Supervisors declaring that the public health, safety and welfare will not be endangered by the business at the location specified in the business license, and that the operation of the business will not violate any zoning or health laws or regulations. The ordinance also requires that prior to the adoption of the resolution, the Board of Supervisors hold a public hearing, the notice of the time, date, place and purpose of which has been published in a newspaper of general circulation in the County at least ten (10) days before the hearing.

On March 21, 2013, Butler Amusements, Inc. filed a business license application, obtained all necessary inspections and staff signatures and paid all necessary fees for the operation of a carnival at Town Center East in El Dorado Hills for a fundraiser for Oakridge High School basketball program. Town Center East is the subject of Planned Development 94-04, which provides for a variety of special events to occur and has a traffic plan for such special events.
