Sheriff's Office recommending the Board approve a Memorandum of Understanding (MOU) and Cost Reimbursement Agreement with the Federal Bureau of Investigation (FBI) retroactive to the beginning of the Federal Fiscal Year 2012/2013, October 1, 2012, for the duration of the Child Exploitation Task Force (CETF) operations to reimburse overtime for officers assigned to the CETF, formerly called the FBI Sacramento Cyber Crime Task Force.

Fiscal Impact/Change to Net County Cost: None. This Agreement will provide reimbursement for overtime expenses incurred by a designated Sheriff Office staff member when working on the CETF.
Reason for Recommendation: For many years, the FBI Cyber Crimes Task Force has been operating under an MOU and cost reimbursement agreements with the Sheriff's Office on cyber-crimes. Recently, the FBI changed the title of its cyber-crimes task force and mission, and is requesting that the Sheriff's Office sign a new MOU and cost reimbursement agreement. The new task force is now the Child Exploitation Task Force (CETF). CETF's mission is to provide a rapid, proactive, and intelligence-driven investigative response to the sexual victimization of children and other crimes against children within the FBI's jurisdiction, to identify and rescue child victims, to reduce the vulnerability of children to sexual exploitation and abuse; to reduce the negative impact of domestic and international parental rights disputes, and to strengthen the capabilities of the FBI and federal, state, local, and international law enforcement through training, intelligence-sharing, technical support, and investigative assistance.
One of the Sheriff's Office detectives has been sworn as a Federal Officer and is qualified to work on the CETF. Overtime costs for this staff member will be submitted to the FBI for reimbursement.
The agreement is retroactive due to the fact that the task force changed its name and focus shortly after the Federal Fiscal Year 12/13 began, and the new MOU had become lost during staff re-assignments both at the FBI and the Sheriff's Office.
Reason for Recommendation:
Approval of this recommendation will ensure that the Sheriff's Office becomes a participant in this new task force, and that overtime reimbursement will be provided by the FBI for work performed.
Action to be taken following Board approval: The Sheriff's Office will return original to the FBI and submit claims for reimbursement.
