Community Development Agency, Transportation Division, recommending the Board authorize the Chair to sign Amendment No. 1 to Cooperative Agreement No. 03-0490 with the State of California Department of Transportation to revise the Funding Summary to include Public Lands Highway Discretionary funds and updated project costs for the construction and maintenance of the Northside School Class I Bike Path - Phase 1 (SR193) and Phase 2 (SR49) Project, CIP No. 72304 and 72306.
FUNDING: State Safe Routes to School (SR2S), Federal Safe Routes to School (SRTS), Congestion Mitigation Air Quality (CMAQ), Public Lands Highway Discretionary (PLHD) funds, Transportation Development Act (TDA) and Regional Surface Transportation Program (RSTP) Rural Exchange funds.

Background
On July 11, 2013, the Transportation Division was notified by the Federal Highway Administration that the Northside School Class I Bike Path - Phase 1 (SR193) and Phase 2 (SR49) Project (Project) was selected to receive Public Lands Highway Discretionary (PLHD) funds in the amount of $300,000. Caltrans Cooperative Agreement 03-0490 dated October 18, 2012 requires the Funding Summary included in the Agreement to be updated each time the funding, billing, and payment details of the Project change.
Amendment No. 1 to the Agreement includes Funding Summary No. 2 which has been revised to include the PLHD funds. The Funding Summary has also been updated to be consistent with the latest Project cost estimates for the Project which is included in the Transportation Division's 2013 Capital Improvement Program adopted June 24, 2013. The PLHD funds will be available after October 1, 2013 and a Program Supplement Agreement to the County's Master Agreement with Caltrans (Administering Agency-State Agreement No. 03-5925R) will be provided to the Transportation Division.
Reason for Recommendation
This Amendment is required to update the Funding Summary included in the Agreement. Article 69 of the Agreement states, "Each PARTNER will designate an authorized representative to sign the FUNDING SUMMARY on its behalf."
Action(s) to be taken following Board approval
1. The Chair will sign two originals of the Amendment.
2. The Clerk of the Board will forward the two originals of the partially executed Amendment to the Transportation Division to send to Caltrans for its approval and signature.
3. The Transportation Division will return one fully executed Amendment to the Clerk of the Board for its files.
