Title: Health and Human Services Agency, Mental Health Division, recommending the Board consider the following: 1) Approve and authorize the Chair to sign Amendment II to Agreement for Services 029-F1111 with the California State Department of Health Care Services, increasing the maximum obligation to $4,407,062 with no change to the term of July 1, 2010 through June 30, 2014, for the provision of alcohol and drug counseling services; and 2) Authorize the Purchasing Agent, or designee, to execute further documents relating to the above noted Agreement for Services 029-F1111, including amendments which do not affect the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management. Fiscal Impact/Change to Net County Cost
There is no change to the Net County Cost associated with this funding Agreement.  Funds for the additional anticipated revenue will be included in the County Budget Request for future Fiscal Years.
 
Background
On December 20, 2011, the Board approved Agreement for Services 029-F1111 for FY 2011-12 to reflect the transition of funding for various programs from the State General Fund to Local Realignment 2011.
 
The California State Budget for FY 2011-12 moved funding for specific State Alcohol and Drug Programs from the State to local governments and, effective July 1, 2012, eliminated Direct Provider contracts with the State for Drug Medi-Cal (DMC) Services.
 
On July 24, 2012, the Board approved California State Department of Health Care Services (CA DHCS) Version 2 of the original of Agreement 029-F111 to retroactively modify the language in Exhibits A for DMC Direct Providers to indicate that the DMC program was funded by Local Realignment rather than by State General Fund.  Additionally, in accordance with the State Budget determination to, effective July 1, 2013, eliminate the Department of Alcohol and Drug Programs (ADP) and as a result of the transitioning of ADP contracts to other State departments, 10-NNA09 for FY 2012-13 assigned responsibility for the DMC portion of the Agreement to the CA DHCS, assigned CA DHCS Agreement Number 12-89210 to the Agreement, and incorporated DMC services funded by Local Realignment into the Agreement.
 
On June 25, 2013, the Board approved Amendment I to this Agreement increasing the compensation, extending the term of the Agreement, and acknowledging implementation of the contingency assignment of the ADP Program from CA Dept. of Alcohol and Drug to the CA DHCS.
 
Reason for Recommendation
The Health and Human Services Agency (HHSA) recommends approval of Amendment II to Agreement 029-F1111 to accept increased funding for the provision of alcohol and drug counseling services provided through the County Alcohol and Drug Program for FY 13-14.
 
Clerk of the Board Follow Up Actions
1. Chair to sign four (4) original Amendment II to Agreement 029-F1111.
2. Clerk of the Board to return four partially executed original Amendment II to HHSA, Contracts Unit, at 3057 Briw Road, Suite A. A copy will be sent to the State for its signature.
3. HHSA will forward one fully executed original to the Clerk of the Board upon receipt.
