Title: Supervisor Santiago recommending the Board conduct a public hearing and adopt Resolution 103-2014 to declare that the operation of a carnival at the Lake Tahoe Community College by Wold Amusements in conjunction with the Kiwanis Annual Community Fair on August 29, 2014 through September 1, 2014 will not endanger the public health, safety and welfare; and, that the operation of a carnival does not violate any zoning or health laws or regulations. This resolution is required for the approval of the business license submitted by Wold Amusements prior to the commencement of the carnival. (Staff recommending this hearing be opened for public comment and continued off calendar)

Body
County Ordinance Code section 5.12.050 of Title 5 (known as the county business license ordinance) requires the operator of a carnival to obtain a business license. In order to obtain the business license, the ordinance requires a resolution of the Board of Supervisors declaring that the public health, safety and welfare will not be endangered by the business at the location specified in the business license, and that the operation of the business will not violate any zoning or health laws or regulations.  The ordinance also requires that prior to the adoption of the resolution, the Board of Supervisors hold a public hearing, the notice of the time, date, place and purposed of which has been published in a newspaper of general circulation in the County at least ten (days) before the hearing.
 
Kiwanis Club of Lake Tahoe for Wold Amusements (doing business as American Traveling Shows) has filed a business license application, which is awaiting Board of Supervisors' approval, to receive a conditional Temporary Use Permit, and has supplied all that is required for the operaiton of a carnival in the City of South Lake Tahoe at the 2nd Annual Kiwanis Community Fair, a fund raiser for for Kiwanis, the South Lake Tahoe Optimist, Tahoe Turning Point, Inc., Live Violence Free, Choices for Children and the Boys and Girls Club. The required notice of the hearing was published in the Tahoe Daily Tribune ten days prior to the public hearing of the Board of Supervisors.
 
Recommendation:  Upon conclusion of the public hearing, Chair be authorized by the Board of Supervisors to sign the resolution; and, Treasurer/Tax Collector to finalize the business license application.
