DEPARTMENT RECOMMENDATION
Community Development Agency, Transportation Division, recommending the Board consider the following:
1) Approve and authorize the Chair to sign the Notice of Acceptance with Sierra Nevada Construction, Inc. for Northside School Class I Bike Path - Phases 1 and 2 Project, CIP No. 72304 (Phase 1, SR193) and CIP No. 72306 (Phase 2, SR49); and
2) Approve and authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from the Transportation Division after the one-year guarantee period.
 
DISCUSSION / BACKGROUND
The contract for the Northside School Class I Bike Path - Phases 1 and 2 Project (Project) was approved by the Board on March 18, 2014, item number 21.  The Project was completed on January 24, 2015.  Recordation of the Notice of Acceptance will start legal time frames for guarantees, a lien period, and return of retention monies.  Recordation of the Notice of Acceptance will start the one-year time frame for releasing the Payment and Performance Bonds to the Surety.

Original Bid:                          $1,495,007.00
Contract Item Cost:                    $1,454,182.00
Contract Change Order Cost:         $246,728.00
Liquidated Damages:                         $108,000.00
Total Direct Construction Cost:      $1,592,910.00
Direct Construction Budget:            $1,722,282.00
 
The contract change order cost includes supplemental items and liquidated damages have been assessed and agreed to at 36 days of delay.
 
Major Contract Change Orders on the Project dealt with:
·      Excavation and disposal of unsuitable materials, temporarily relocate a private 2 inch domestic water line, and over excavation of the Knickerbocker Creek Arch Culvert wing wall footings at Phase 2.
·      Extending an existing 30 inch diameter corrugated metal pipe at Knickerbocker Creek.
·      Grind and reconstruct various driveways, grade and place Aggregate Base at Horse Access and at Cave Valley Road shoulder, and remove a section of simulated wood fence in Phase 2.
·      Construction of metal beam guard rail, salvaging and deliver the existing street light, pick up and deliver a replacement street light provided by California Department of Transportation, as well as changes to the street light as required.
 
The costs listed are estimates.  Community Development Agency, Transportation Division (Transportation) will be closing out the Project with the Contractor and finalizing costs over the coming weeks.  Any significant deviations from the estimates above that exceed Transportation's allocated authority will be brought back for the Board for review and approval in a subsequent agenda item.

CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on the Notice of Acceptance.
2) The Clerk of the Board will send the Notice of Acceptance to the Recorder/Clerk's Office for recordation within ten (10) days and forward a copy of the recorded Notice of Acceptance to Transportation.
 
TRANSPORTATION FOLLOW UP ACTIONS
One year after the recordation of the Notice of Acceptance, Transportation will verify that all warranty work, if any, has been satisfactorily completed and will notify the Clerk of the Board in writing to release the Bonds.
