DEPARTMENT RECOMMENDATION
Community Development Agency, Transportation Division (Transportation), recommending the Board consider the following:
1) Approve and authorize the Chair to sign the Notice of Acceptance with JD Pasquetti Engineering, Inc. for Francisco Drive Right-Turn Pocket Project, Contract No. PW 14-31068, CIP No. 71358, P&C No. 096-C1599; and
2) Approve and authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from the Community Development Agency, Transportation Division, after the one-year guarantee period.
 
DISCUSSION / BACKGROUND
The contract for the Francisco Drive Right-Turn Pocket Project (Project) was approved by the Board on November 13, 2014, item number 3.  Construction was substantially completed on May 12, 2015.  Recordation of the Notice of Acceptance will start legal time frames for guarantees, a lien period, and return of retention monies.  Recordation of the Notice of Acceptance will start the one-year time frame for releasing the Payment and Performance Bonds to the Surety.

Major Contract Change Orders on the Project dealt with:
·      Changes to saw cut location, grinding and paving limits of El Dorado Hills Blvd.
·      Changes to the bike path and curb ramp detail along El Dorado Hills Blvd.
·      Intersection and striping changes along Francisco Drive and El Dorado Hills Blvd.
·      Unsuitable material that was discovered during the course of constructing the widened roadway.
 
The final costs listed are estimates.  Transportation will be closing out the Project with the Contractor and finalizing costs over the coming weeks.  Any significant deviations from the estimates above that exceed Transportation's allocated authority will be brought back for the Board for review and approval in a subsequent agenda item.

CAO RECOMMENDATION
CAO recommending the Board move staff's recommendation as this is an approved CIP project and the requested actions are consistent with standard practices.
 
FINANCIAL IMPACT
There is no change to Net County Cost associated with this item.  Funding for the Project is budgeted in the adopted 2014 Capital Improvement Program and is provided by the Congestion Mitigation and Air Quality Program, Urban Regional Surface Transportation Program, and Transportation Enhancement Activities.  The anticipated direct construction cost is less than the direct construction budget established by the Board.
 
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on the Notice of Acceptance.
2) The Clerk of the Board will send the Notice of Acceptance to the Recorder/Clerk's Office for recordation within ten (10) days and forward a copy of the recorded Notice of Acceptance to Transportation.
3) One year after the recordation of the Notice of Acceptance, Transportation will verify that all warranty work, if any, has been satisfactorily completed and will notify the Clerk of the Board in writing to release the Payment and Performance Bonds.
