Community Development Agency, Transportation Division, recommending the Board approve and authorize the Chair to sign the Long Term License Agreement between the California Tahoe Conservancy and El Dorado County (California Tahoe Conservancy CTC 2015-0422 LT No. 164 - El Dorado County) for County use of a land parcel owned by the California Tahoe Conservancy to complete and maintain the Lake Tahoe Boulevard Erosion Control/ Stream Environment Zone Project, Contract No. PW 14-31076, CIP Nos. 95163/95175.

 

DISCUSSION / BACKGROUND

The Transportation Division (Transportation) will begin construction on the Lake Tahoe Boulevard Erosion Control/ Stream Environment Zone Project (Project) as early as August 31, 2015.  Project improvements include grading and revegetation activities, drainage improvements, and water quality features.  Installation and subsequent long term (20 years) maintenance of some of these project improvements are on a California Tahoe Conservancy (CTC) owned parcel (Assessor's Parcel Number 033-010-20).  Exhibit A of License Agreement CTC 2015-0422 LT No. 164 - El Dorado County (License Agreement) further describes the proposed improvements planned for this parcel.

County Counsel

 

CAO RECOMMENDATION

CAO recommending the Board move staff's recommendation as the subject agreement does not include a financial obligation from the County and use of the subject property is needed to complete the referenced approved CIP projects.

 

FINANCIAL IMPACT

There are no fees or assessments relative to the subject License Agreement.  The proposed improvements to the CTC parcel are budgeted in the current Capital Improvement Program and contribute to the County's compliance with its National Pollutant Discharge Elimination System permit.  Future maintenance of the improvements will be accommodated within Transportation's existing operating budget.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair's signature on each of the two (2) originals of the License Agreement.

2) The Clerk of the Board will complete the All Purpose Notary Acknowledgement provided.

3) The Clerk of the Board will send the two (2) originals of the partially-executed License Agreement and the All Purpose Notary Acknowledgement to Transportation for processing to the CTC for signature.
