Community Development Agency, Transportation Division, recommending the Board consider the following:
1) Approve and authorize the Chair to sign the Notice of Acceptance with DeSilva Gates Construction, L.P. for the U.S. 50 HOV Lanes Phase 0 Project, CIP No. 53124, Agreement No. 12-30639, P&C No. 157-C1399; and
2) Authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from the Community Development Agency, Transportation Division after the one-year guarantee period.
FUNDING: This Project was funded with State Corridor Mobility Improvement Account (83%), Tribe Funding (17%) and the Road Fund (<1%). (No Federal Funds)

Community Development Agency, Transportation Division, recommending the Board consider the following:

DISCUSSION / BACKGROUND
The contract for the U.S. 50 HOV Lanes Phase 0 was approved by the Board on June 19, 2012 (Item No. 13). Construction was substantially completed on March 31, 2015. Recordation of the Notice of Acceptance will start legal times for guarantees, a lien period and return of retention monies. Recordation of the Notice of Acceptance will also start the one-year time frame for releasing the Payment and Performance Bonds to the Surety.

Major Contract Change Orders on the Project dealt with the following:
• Temporary suspension in 2012/2013 winter season and subsequent mitigation during summer of 2013.
• Installing, maintaining and removing temporary water pollution control measures.
• Raise existing electrical pull boxes to grade and replace lids with traffic rated lids.
• Replace Geosynthetic Pavement Interlayer line item with GlasGrid 8502 to provide a stronger pavement interlayer material for the deteriorated existing asphalt.
The costs listed are estimates. Transportation will be closing out the Project with the Contractor and finalizing costs over the coming weeks. Any significant deviations from the estimates above that exceed Transportation’s allocated authority will be brought back for the Board for review and approval in a subsequent agenda item.

CAO RECOMMENDATION
CAO recommending the Board move staff's recommendation to approve and authorize the Chair to sign the Notice of Acceptance for the U.S. 50 HOV Phase 0 project, CIP 53124 and authorize the Clerk to release the Payment and Performance Bonds as noted.
FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. The anticipated direct construction cost is less than the direct construction budget established by the Board. The Project is included in the adopted 2014 Capital Improvement Program, with funding provided by State Corridor Mobility Improvement Account (83%), Tribe Funding (17%), and the Road Fund (<1%).
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will send the Notice of Acceptance to the Recorder/Clerk’s Office for recordation within ten (10) days and forward a copy of the recorded Notice of Acceptance to Transportation.
2) One year after the recordation of the Notice of Acceptance, Transportation will verify that all warranty work, if any, has been satisfactorily completed and will notify the Clerk of the Board in writing to release the Bonds.
