District Attorney recommending the Board authorize the Chair to sign the following Memorandums of Understanding (MOU) for the term October 1, 2015 through September 30, 2016 in support of the Holiday Driving Under the Influence Program - "Avoid the 6 Program", a cooperative effort to reduce alcohol related injury and fatal traffic collisions in El Dorado County:
1) MOU 205-M1611 between the District Attorney and the Probation Department;
2) MOU 200-M1611 between the District Attorney and the El Dorado County Sheriff's Office;
3) MOU 206-M1611 between the District Attorney and the South Lake Tahoe Police Department; and
4) MOU 204-M1611 between the District Attorney and the Placerville Police Department.

Background
Pursuant to a grant award from the State of California,Office of Traffic Safety, the El Dorado County District Attorney's Office and El Dorado County and City Law Enforcement Agencies will, during the term of October 1, 2015, through September 30, 2016, participate in the " Avoid the 6 Program", providing DUI enforcement staff on an overtime basis and shall commit to participate in all project related enforcement activities, attend project-related meetings to schedule and coordinate activities, and to encourage officers to emphasize DUI enforcement during all phases of the grant. The grant funds will be used to reimburse Law Enforcement Agencies for any overtime payroll expense as a result of this program.
Reason for Recommendation
The District Attorney has been designated as the "Grantor" for the Avoid 6 Program for El Dorado County from the State of California Office of Traffic Safety, Grant No. AL1529. This will enable the District Attorney to serve as a host agency for a Regional DUI effort in El Dorado County to reduce alcohol-involved fatalities and injuries during the holiday enforcement periods of October 1, 2015, through September 30, 2016.
Budgeted grant activities will be conducted by law enforcement personnel pursuant to the MOU on an overtime basis; overtime hours and related expenses will be reimbursed under Grant No. AL1636 and MOU Nos. 205-M1611, 200-M1611, 206-M1611, and 204-M1611. Grant funds cannot be used to supplant existing services. Therefore, only hours spent in excess of regular working hours can be funded with this grant.
The term of the Project Period is October 1, 2015, through September 30, 2016. The MOU is retroactive to October 1, 2015. District Attorney will not be providing any services under this MOU until is is approved by the Board.
The County of El Dorado employee responsible for administering this MOU is Vern Pierson, District Attorney.
Action(s) to be taken following Board approval
(1) Board Chair to sign original MOU for each agency and return one copy of each to the District Attorney
(2) District Attorney to make copies of fully executed MOU's and provide to law enforcement agency(ies).
(3) Law enforcement agencies to submit invoices and backup documentation to the District Attorney for reimbursement for enforcement activities pursuant to the MOU.
