1) Approve and authorize the Chair to sign the Notice of Acceptance with Don Garcia Excavating & Paving, Inc. for the Black Bart Avenue, Barbara Avenue and Martin Avenue Overlay Project, CIP 72188, Agreement PW 15-31100, P&C 386-C1599; and
2) Authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from the Community Development Agency, Transportation Division after the one-year guarantee period.
FUNDING: General Fund (65%), Road Fund (27%), and Regional Surface Transportation Program Grant Funds (8%).

DEPARTMENT RECOMMENDATION
Community Development Agency, Transportation Division (Transportation), recommending the Board consider the following:
1) Approve and authorize the Chair to sign the Notice of Acceptance with Don Garcia Excavating & Paving, Inc. for the Black Bart Avenue, Barbara Avenue and Martin Avenue Overlay Project (Project), CIP No. 72188, Agreement PW No. 15-31100, P&C No. 386-C1599; and
2) Authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from Transportation after the one-year guarantee period.
DISCUSSION / BACKGROUND
The contract for the Project was approved by the Board on August 11, 2015 (Item No. 21). Construction was substantially completed on October 9, 2015. Recordation of the Notice of Acceptance will start legal time frames for guarantees, a lien period and return of retention monies. Recordation of the Notice of Acceptance will also start the one-year time frame for releasing the Payment and Performance Bonds to the Surety.

Major Contract Change Orders (CCO) on the Project dealt with the following:
• CCO#1- Additional costs associated with using a 1/4” strike pattern versus a 5/8” strike pattern for milling of asphalt to better protect the existing asphalt surface during milling operations and to provide a better surface for adhesion of the paving grid product.
• CCO#2 - Removal and salvage of 4 transverse drains that had settled over time and backfilling of the void with concrete slurry cement. County maintenance staff re-installed the transverse drains at the new finish grade elevation after completion of the Project.
• CCO#3 - Install and compact aggregate base shoulder backing along both sides of Barbara Avenue after paving was completed.
The costs listed are estimates. Transportation will be closing out the Project with the Contractor and finalizing costs over the coming weeks. Any significant deviations from the estimates above that exceed Transportation’s allocated authority will be brought back for the Board for review and approval in a subsequent agenda item.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. The anticipated direct construction cost is less than the direct construction budget established by the Board.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) Clerk to obtain the Board Chair's signature on the Notice of Acceptance.
2) The Clerk will send the Notice of Acceptance to the Recorder/Clerk’s Office for recordation within ten (10) days and forward a copy of the recorded Notice of Acceptance to Transportation.
3) One year after the recordation of the Notice of Acceptance, Transportation will verify that all warranty work, if any, has been satisfactorily completed and will notify the Clerk of the Board in writing to release the Bonds.
