Fiscal Impact/Change to Net County Cost:  No change.  Funds were budgeted for FY 2005/06 and FY 2006/07.  The remainder was included in the FY 2007/08 County Budget Request.  
 
Background: On March 1, 2005, the Board executed Agreement #405-S0511 with Progress House, Inc. to provide therapeutic counseling and other related services for clients of the Department of Human Services on an as requested basis.  Amendments I and II to this Agreement expanded and clarified services with corresponding amendments to the rates.  Amendment III to this Agreement reflected rates more favorable to the County.  Amendment IV extended the term for one (1) year but did not increase the maximum compensation as projections indicated that remaining funds were sufficient to cover the term extension.  
 
Reason for Recommendation: The provision of therapeutic counseling, inpatient and outpatient substance abuse testing and other related services continues to prove to be a successful tool to promote reunification of families served by the Department of Human Services, Social Services Division (DHS).  DHS recently experienced a substantial increase in the need for these services from Progress House (Contractor), which has resulted in the depletion of funds available for services under this contract.  Additionally, notification was received from the Contractor in late April that a rate adjustment would become effective July 1, 2007 to reflect the proposed new Medi-Cal Drug Rate.  An increase to the maximum compensation became necessary to ensure continuation of services to DHS clients.  Approving execution of this amendment contingent upon County Counsel and Risk Management concurrence will prevent interruption of necessary services to these clients.  A request for the necessary contract amendment was submitted to Procurement and Contracts in mid-May to accommodate the higher than anticipated use of services and impending rate increase.  Because the time required to achieve compliance with recent changes to Board of Supervisors Policy C-17 requirements as they relate to contracts over $100,000 resulted in a delay in processing, this Amendment is being submitted retroactively and DHS is recommending that the Board authorize execution of Amendment V to Agreement for Services #405-S0511, contingent upon receipt of required concurrences, with an effective date of July 1, 2007.
 
Purchasing Agent Recommendations:  The Human Services Department has contracted with Progress House, Inc. for the provision of substance abuse treatment services, anger management, therapeutic counseling, substance abuse testing, and other related services on an "as needed" basis.  The Procurement and Contracts Division has processed Amendment V to the subject agreement.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for minor clarifications in the scope of work, provides for new billing rates effective July 1, 2007, and increases the compensation by $300,000.00 for a total not to exceed $600,000.00.  The amendment does not call for a term extension, as the contract does not expire until February 28, 2008.  
 
The Purchasing Agent has coordinated the review of the contractor's qualifications to perform the needed services with Gayle-Erbe-Hamlin, Director of Public Health.  The Purchasing Agent concurs that Progress House, Inc. has demonstrated its ability to perform the work based on prior experience with this contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  Additionally, the contractor provides similar services to other departments within the County.
 
The County Purchasing Agent has reviewed the department's request to contract with Progress House, Inc. and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Human Services Department.
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by Progress House, Inc. as the department contracts with multiple local area firms to provide similar services to its clients on an "as needed" basis.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Upon receipt of required concurrences, Procurement and Contracts to provide the Board Clerk with the approved Blue Route and two (2) originals of Amendment V to Agreement for Services #405-S0511 for execution by the Chairman.  Board Clerk to return two executed copies of Amendment V to Agreement for Services #405-S0511 to Procurement and Contracts.  Auditors Office to authorize payment of future invoices.
