Fiscal Impact/Change to Net County Cost: None

Background: Title 5 of the El Dorado County Ordinance Code is entitled "Business Taxes, Licenses and Regulations". Chapter 5.10 of Title 5 is entitled "County Property Vending Licenses". The recommended ordinance would amend Section 5.10.070 Chapter 5.10, which is entitled "Vending License Application Process".

Reason for Recommendation: The current language in this section of the Ordinance Code requires the County to use the informal bidding procedures for public projects to solicit bids for vending operations on County property and to award the contract to the bidder proposing the highest license fee revenue. The use of a competitive process for awarding vendor license agreements helps to ensure the best value for the County; however, the public project informal bidding process applies to the construction, renovation, or alteration of a public facility, and is therefore not appropriate for the soliciation of vending operations.

The RFP process as defined in Board Policy C-17-Procurement, ensures competition yet provides flexibility for prospective vendors and the County. The proposed ordinance amends the requirement for competition to specify the use of the RFP process. In addition, it allows the Board to authorize an exemption to the requirement for use of a competitive process for a vending operation that is ancillary to a facility management agreement.
