DEPARTMENT RECOMMENDATION
Community Development Services, Planning and Building Department, recommending the Board authorize the Chair to sign a letter to the Tahoe Regional Planning Agency (TRPA) Governing Board recommending the appointment of Brendan Ferry, a Long Range Planning Principal Planner, to the Agency’s Advisory Planning Commission (Commission), to participate as El Dorado County’s designated alternate and replacement for Roger Trout, Interim Director of Planning and Building (Attachment 3A).
DISCUSSION / BACKGROUND
On February 22, 2011, an opinion was requested from County Counsel (Counsel) to clarify the process of appointments that are made to the Commission according to the TRPA Compact. On February 25, 2011, an opinion was received from Counsel stating that technically the Board of Supervisors does not make appointments to the Commission. In Article III, Section (h), of the Compact it states, "An advisory planning commission shall be appointed by the agency" (agency is specifically defined by the Compact as TRPA). In the same section of the Compact, it states that “the Chief Planning Officer of El Dorado County shall be appointed.” However, the Compact further provides that any official may designate an alternate. Therefore, in order to better balance workloads and provide an opportunity for a local Tahoe Planner to provide input to the Commission, Brendan Ferry is being recommended as the designated alternate and replacement for Roger Trout, the Interim Director of the Community Development Services, Planning and Building Department.

1) The Clerk of the Board will obtain the Chair’s signature on the original letter of recommendation to appoint Brendan Ferry, and mail it to the TRPA Governing Board, attention of Marja Ambler, Board Clerk, P.O. Box 5310, Stateline, Nevada, 89449.
2) The Clerk of the Board will forward two (2) copies of the signed letter of recommendation to appoint Brendan Ferry to the Community Development Services, Planning and Building Department, attention of Cindy Johnson, for distribution to Roger Trout and Brendan Ferry.
