DISCUSSION / BACKGROUND
Title 5, known as the County Business License Ordinance, Chapter 5.56, Vacation Home Rental (VHR) Ordinance, was adopted by the Board of Supervisors in 2004 to regulate the ownership and operation of vacation home rentals in the unincorporated areas of the Lake Tahoe Basin. The Ordinance was amended in 2009 and in 2016 in response to citizens’ concerns regarding noise, parking, garbage and other issues.
The Treasurer-Tax Collector’s Office has responsibility under the Ordinance for the issuance of permits, collection of fees, investigation of complaints, levying of penalties and, when necessary, the revocation of Vacation Home Rental Permits. The attached PowerPoint presentation (Attachment B: VHR-Who Does What) outlines the process that has been established when a complaint related to a VHR is received. The steps involved to investigate the compliant up to and including a hearing are described. As is evident in the presentation, enforcement of the VHR ordinance involves multiple departments and agencies working together.
At its September 12 meeting, the Board of Supervisors formed an Ad Hoc subcommittee to investigate suggestions from citizens in the Lake Tahoe Basin regarding VHRs and to develop recommendations regarding amendments to the Ordinance. Since enforcement of the Ordinance involves multiple agencies, the ad hoc subcommittee is comprised of representatives from the Treasurer-Tax Collector, Sheriff, County Counsel, Chief Administrative Office, Supervisor Novasel-District 5, Supervisor Ranalli-District 4.
