Transportation Department recommending adoption of Resolution accepting the Correctory Irrevocable Offer of Dedication from West Valley LLC, for road right of way, including the underlying fee, located on property identified as APN 118-140-37 in El Dorado Hills, necessary in order to make the current road right of way on Latrobe Road more uniform in width, noting adoption of said Resolution supersedes Resolution 059-2009 previously adopted on March 24, 2009, as Item 13.

Fiscal Impact/Change to Net County Cost: None. There is no net cost to the County General Fund associated with this agenda item.
Reason for Recommendation:
On March 24, 2009, the Board adopted a Resolution accepting an Irrevocable Offer of Dedication from West Valley LLC for road right of way, including the underlying fee, located on the property identified as APN 118-140-37. Subsequent to the adoption and recording of said Resolution, the County Surveyor's office discovered a few minor technical errors on the related legal description and plat that was prepared by the Department of Transportation. A new legal description and plat has been prepared and a Correctory Irrevocable Offer of Dedication has been executed by West Valley LLC.
The Department of Transportation's staff has reviewed said offer and recommends that the Board adopt and authorize the Chairman to sign the Resolution accepting said offer, at this time. Adoption of said Resolution supersedes Resolution 059-2009, which was adopted on March 24, 2009, Item 13. Authorization for recording said offer is pursuant to Government Code Section 7050.
Action to be taken following Board approval:
1. Said Resolution, Correctory Irrevocable Offer of Dedication and Exhibits will be recorded by the Board Clerk.
2. Copies of the recorded Resolution, Correctory Irrevocable Offer of Dedication and Exhibits will be sent to the property owner by Department of Transportation Right of Way staff.
