Community Development Services, Department of Transportation (Transportation), recommending the Board consider the following:

1)  Approve and accept the State of California Standard Grant Agreement CTA 17 013L with the California Tahoe Conservancy in the amount of $250,000 for the implementation of Phases 1 and 2 of the Country Club Heights Erosion Control Project, CIP 95191;

2)  Approve and accept the State of California Standard Grant Agreement CTA 17 019L with the California Tahoe Conservancy for $250,000 for planning of Phase 3 of the Country Club Heights Erosion Control Project, CIP 95191;

3)  Authorize the Chair to sign the State of California Standard Grant Agreements CTA 17 013L and CTA 17 019L; and

4)  Authorize the Director of Transportation to execute any future amendments or modifications to Grant Agreements CTA 17 013L and CTA 17 019L that do not increase the current grant amounts of $250,000 each.

 

DISCUSSION / BACKGROUND

On June 20, 2017 (Item 23), the Board approved Resolution 097-2017 confirming its support for the planning and implementation grant proposals under the State’s Proposition 1, Water Quality, Supply, and Infrastructure Improvement Act of 2014 (2014 Water Bond) with the CTC.  The 2014 Water Bond allocates funds for multi-benefit ecosystem and watershed protection and restoration projects.  Transportation’s applications successfully competed with other public agencies, federally-recognized Native American tribes and eligible nonprofit agencies and were recommended for award by CTC staff and its application review team.

 

On September 21, 2017, the CTC Governing Board authorized the award of Grant Agreements CTA 17 013L and CTA 17 019L (Agreements) to El Dorado County.  CTA 17 013L will provide $250,000 for the implementation of Phases 1 and 2 of the Country Club Heights Erosion Control Project (Project).  CTA 17 019L will provide $250,000 for the planning of Phase 3 of the Project.

 

The Project site is within an existing residential development located in the unincorporated area of South Lake Tahoe, between U.S. Highway 50/State Route 89 and Pioneer Trail.  The proposed Project will improve water quality by stabilizing bare soils with native vegetation, restoring and expanding stream environment zones, enhancing drainage features, and installing drainage infiltration systems to reduce stormwater runoff.  The proposed improvements will reduce the discharge of sediment and pollutants to Lake Tahoe from County administered rights-of-way in the Project area.  The Project will not change the use of the site or surrounding area.

 

During the term of the Agreements, Transportation anticipates there may be a need to request that the CTC further modify the terms of the Agreements, generally related to administrative issues, project schedules, and budgets.  Transportation is requesting that the Board delegate authority to the Director of Transportation to execute these types of amendments or modifications.  If a future amendment or modification proposes to increase the current funding amount of either Agreement, Transportation will bring it to the Board for consideration.

 

ALTERNATIVES

The Board could choose to not approve and accept the Grant funds and not authorize the Chair’s signature on the Agreements.  Transportation would then be unable to move forward with the Project until different funding is secured.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel and Risk Management have reviewed and approved both Agreement documents.

 

CAO RECOMMENDATION

It is recommended that that Board approve this item.

 

FINANCIAL IMPACT

Approval of this item will have no impact to the Net County Cost.  Approval of the proposed Agreements will allow Transportation to receive a total of $500,000 of State revenue through the CTC, which will be programmed and reflected as part of the 2017 CIP mid-year adjustment.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair's signature on each of the three (3) originals of the Agreements.

2) The Clerk of the Board will send the three (3) originals of the partially-executed Agreements to Transportation - Tahoe Engineering Unit, Attention: Patty Scott for further processing.
