DEPARTMENT RECOMMENDATION

Community Development Agency, Transportation Division (Transportation), recommending the Board approve and authorize the Chair to sign the First Amendment (Amendment) to Agreement 415-S1511 (Agreement) with North State Resources, Inc. (NSR), increasing compensation by $17,861.60 for a new not-to-exceed amount of $80,549.35, to provide extended cultural studies for the Oak Hill Road at Squaw Hollow Creek - Bridge Replacement Project (Project), CIP 77134, PW 15-54148.

 

DISCUSSION / BACKGROUND

On April 10, 2015, the Purchasing Agent approved and signed the Agreement with NSR to provide environmental services for the Project with a not-to-exceed amount of $62,687. 

 

The proposed Amendment is necessary because of the potential cultural sensitivity of the Project’s Area of Potential Effects (APE), the presence of a known cultural site in and adjacent to the APE, and the heightened interest of members of the Native American community in the Project area.  Additional cultural investigations and documentation are necessary to evaluate impacts on cultural resources, particularly tribal cultural resources, and to comply with the California Department of Transportation's environmental guidelines and consultation requirements under the National Historic Preservation Act and California Environmental Quality Act. These investigations will include additional research, communications with Native American tribes, and additional testing in the Area of Direct Impacts.

 

ALTERNATIVES

1) The Board could choose to not approve the proposed Amendment.  Transportation would make any requested changes and return to the Board at a later date.

2) The Board could choose to cancel the Project, however, the Board approved the Project previously and the County might have to refund monies already spent to the Highway Bridge Program. 

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

The proposed Amendment has been approved by County Counsel and Risk Management.

 

CAO RECOMMENDATION

Chief Administrative Office concurs with staff's recommendations.

 

FINANCIAL IMPACT

Funding for the Agreement will be provided by the Highway Bridge Program. The Project is included in Transportation's 2015 Capital Improvement Program which was adopted by the Board on June 16, 2015 (Item 40).  There is adequate capacity in the Project's planning and environmental budget to fund the proposed Amendment.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1)  The Clerk of the Board will obtain the Board Chair's signature on two (2) copies of the proposed First Amendment.

2)  The Clerk of the Board will return one (1) of the signed original copies of the First Amendment to Sandra Ewert, Community Development Agency, Administration and Finance Division, Contracts and Procurement Unit for further processing.
