Hearing to consider the Agricultural Commission's criteria including modifications to apply that criteria to be utilized for RR, NR, OS & AL Land Use Designations. (Cont'd 3/24/09, Item 18)

RECOMMENDED ACTION:  Planning Commission recommending the Board of Supervisors adopt the proposed amendment to General Plan Policy 8.1.3.1 and the revised Criteria Resolution as recommended by the Agricultural Commission.
 
Staff recommends the Board take the following action:  1. Adopt the CEQA findings (Attachment 1); 2. Adopt the Negative Declaration environmental document (Attachment 2); 3. Adopt the proposed amendment to General Plan Policy 8.1.3.1 (Amendment 3); and 4. Adopt the Criteria Resolution (Attachment 4).
 
Background: These applications were initially considered by the Planning Commission on October 9, 2008.  After hearing public testimony, the Commission continued the item to December 11, 2008, to allow the Agricultural Commission time to discuss streamlining the process.  On December 11, 2008, after hearing public testimony, the Planning Commission unanimously (4-0) recommended the application for approval.
 
Bill Stephans, Agricultural Commissioner, stated that the Agricultural Commission felt they have a task to perform and that it is appropriate to review each project.  With the proposed criteria, there would be two (2) exceptions to this; projects zoned Agricultural Preserve (AP) or Open Space (OS).  These types could be approved by the Development Services Director with concurrence of the Agricultural Commissioner.  If there is no concurrence, then it would be forwarded to the Agricultural Commission for review.
