DEPARTMENT RECOMMENDATION

Community Development Services, Environmental Management Department, is recommending the Board authorize the Chair to execute Agreement for Services 2098 with Global Labs, Inc., doing business as California Laboratory Services, for the provision of as-needed collection and analysis of groundwater, surface water, storm water, wastewater, soil, hazardous materials, and hazardous waste sample testing services for the Union Mine Disposal Site and other various County locations, with a not-to-exceed amount of $300,000, and with a term of three (3) years.

 

Make findings that an outside independent consultant can more economically and feasibly perform work in accordance with County Ordinance Chapter 3.13, Section 3.13.030.

 

DISCUSSION / BACKGROUND

In 2017, the Community Development Agency (CDA) and County’s Procurement and Contracts Division issued Request for Qualifications 17-918-020 to establish a list of qualified firms for twenty-five (25) categories of professional services, including a category for laboratory testing and sample analysis services.

 

In accordance with procurement Policy C-17, Section 7.10, Request for Qualifications, the CDA formed an evaluation committee to review all the categories.  The committee reviewed responses for the category of laboratory testing and sample analysis services on the basis of each consultant’s specific experience and California accreditation specified by California Health and Safety Code sections 100825 through 100920  to successfully provide the full range of services, demonstration of management and organizational ability relative to time management, scheduling and staff/client relationships, history of repeat business with clients, demonstration of understanding community social relationships and citizen’s environmental concerns, and amount of work performed internal to the prime consultant.  It was determined that CLS is qualified to provide these services for the Union Mine Disposal Site and other various County locations on an as-needed basis, including for the Certified Unified Program Agency (CUPA).  Environmental Management is certified by the State of California Environmental Protection Agency as the CUPA to implement the hazardous materials regulatory programs, including the hazardous materials storage, hazardous waste generators, hazardous waste onsite treatment, and underground storage tank programs. In addition Environmental Management may provide oversight for contaminated sites and is the agency responsible for hazardous materials incident response within the County.

 

Environmental Management has worked with CLS for the past six years.  Services provided by CLS include courier service at no additional charge for the safe collection and analysis of groundwater, surface water, storm water, wastewater, soil, hazardous materials, and hazardous waste sample testing.  Varying degrees of analytical testing of groundwater, surface water, wastewater, storm water, soil hazardous materials, and hazardous waste are required either by law, permit, and/or public safety.  .  

 

The County no longer operates a laboratory; therefore, the County does not provide any of these services. Prior to the County closing its laboratory, the County's laboratory was unable to perform the majority of the tests required, did not have a courier service to pick up samples from the various locations, and did not provide after hours, weekend, and emergency testing services.

 

ALTERNATIVES

The Board may choose to deny the approval of the proposed Agreement. This would result in Environmental Management being unable to have these services provided and would not be in compliance with state and federal testing and reporting requirements for the Union Mine Disposal Site. 

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel and Risk Management have approved the proposed Agreement.

 

CAO RECOMMENDATION

 It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Funding is available in Fiscal Year 17/18 and will be available in the FY18/19 and 19/20 recommended budgets. There is no change in Net County Cost.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Board Clerk will obtain the Chair’s signature on two (2) originals of the Agreement; and

2) The Board Clerk will forward one (1) original of the Agreement to the Chief Administrative Office, Procurement and Contracts Division, for distribution.
