DEPARTMENT RECOMMENDATION

Surveyor's Office recommending the Board adopt a Resolution of Vacation for Abandonment of Easement (AOE) 17-005 to abandon public utility easements on Lots 384 and 382 of "Waterford Unit No. 5", recorded at Book G of Subdivisions at Page 133, identified as Assessor's Parcel Numbers (APNs) 110-253-12 and 110-253-10, requested by the owners, Joseph M. Rondone and Valerie L. Rondone as owners of Lot 384 and Jacob Stephenson and Jill Stephenson as owners of Lot 382.

 

DISCUSSION / BACKGROUND

A request has been submitted by Joseph M. Rondone and Valerie L. Rondone as owners of Lot 384, APN 110-253-12 and Jacob Stephenson and Jill Stephenson as owners of Lot 382, 110-253-10, requesting that the County of El Dorado, Board of Supervisors, vacate a portion of the public utility easements that are located on the subject properties. Said easements are more particularly described in Exhibit A1, A2, and depicted on Exhibit B1, B2 of the attached Resolution.

 

The Rondones and Stephensons are currently processing Boundary Line Adjustment (BLA)17-0010. They need to complete this abandonment prior to completion of the BLA in order to eliminate easements that will not follow their new boundaries.

 

The public utility easements, as shown on Lots 384 and 382 of "Waterford Unit No. 5", recorded at Book G of Subdivisions at Page 133 were offered to the County of El Dorado by, Southfork Partnership a General Partnership, on March 28, 1989. The easements were acknowledged and accepted by the County of El Dorado on June 27, 1989 and the Subdivision Map recorded on July 28, 1989.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 17-005. By utilizing this alternative, the owners of APNs 110-253-12 and 110-253-10, would be prevented from pursuing development that would impact these easements.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said easements for the purpose for which they were dedicated and find no present or future need exists for subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no fiscal impact or Net County Cost associated with this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution to the Surveyor's Office for further processing.
