DISCUSSION / BACKGROUND
At their meeting of March 13, 2018 (Item 20), the Board approved Ordinance 5081 and set for Final Passage (Second Reading) on March 20, 2018.
On January 23, 2018 (File 18-0109, Item 12) the Ad Hoc committee, comprised of Supervisors Novasel and Frentzen, conceptually approved an ordinance to establish a Human Rights Commission for El Dorado County pursuant to Board Policy A-3 and directed the Clerk of the Board to submit a draft ordinance to County Counsel for their review and for staff to return to the Board no later than March 13, 2018 with an introductory ordinance for Board consideration.
On March 7, 2017 (Item 26, File 17-0255) the Board adopted Resolution 048-2017 Promoting Civility, Respect, Tolerance, and Human Rights and formed an ad hoc committee consisting solely of Supervisors Novasel and Frentzen to work with staff on the potential establishment of a Civil/Human Rights commission. The purpose of the commission is to promote tolerance and mutual respect between all persons, and to promote positive human relationships for the purpose of insuring public peace, health, safety and the general welfare.
Government Code section 50262 states in part, "The governing body of any city or county may, by ordinance, create a commission on human relations."

ALTERNATIVES
The Board may direct the Ad Hoc committee to conduct further analysis; direct staff to amend the ordinance or take other action.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
County Counsel reviewed and as to form, approved the draft ordinance.
FINANCIAL IMPACT
There is no direct financial impact. No staffing resources are allocated to support the commission. There are no funding sources identified for commission operations and the ordinance indicates resident members are not compensated.
CLERK OF THE BOARD FOLLOW UP ACTIONS
Upon approval of the Introduction of the Ordinance, the Clerk will:
1) Publish a summary ordinance in the Mountain Democrat and continue this item to March 20, 2018 for Final Passage (Second Reading).
2) Publish a Notice of Vacancy for all resident member positions pursuant to the Maddy Act.
Upon adoption of the Final Passage of the Ordinance, the Clerk will:
1) Obtain the Chair's signature on the original Ordinance and transmit an electronic version to Municode for inclusion in the codified Ordinance Code.
2) Add the commission information to the online committees and commissions webpage.
