Health and Human Services Agency, recommending the Board adopt and authorize the Chair to sign Resolution 058-2018, thereby:

1) Approving revision of the name of the Mental Health Commission to the Behavioral Health Commission; and

2) Adopting the revised Bylaws of the El Dorado County Behavioral Health Commission pursuant to California Welfare and Institutions Code Section 5604.  (Est. Time: 10 MIn.)

DEPARTMENT RECOMMENDATION: 

Health and Human Services Agency (HHSA) recommending the Board adopt and authorize the Chair to sign the attached Resolution, thereby approving revision of the name of the Mental Health Commission to the Behavioral Health Commission, and adopting the revised Bylaws of the El Dorado County Behavioral Health Commission pursuant to California Welfare and Institutions Code Section 5604.

 

DISCUSSION / BACKGROUND:

California Welfare and Institutions Code Section 5604 requires all counties to establish a mental health advisory board or commission.  The County of El Dorado Board of Supervisors established the El Dorado County Mental Health Commission (Commission) and adopted Bylaws for the Commission through previous actions on February 29, 2000 and October 21, 2014.  Resolution 177-2014 will be superseded by this Resolution 058-2018.

 

The Commission determined a need to review its Bylaws, and update its name, to ensure compliance with current statewide best practices, incorporating substance use disorders and mental health treatment into an integrated approach to client treatment.  Changing the name of the Commission from the Mental Health Commission to the Behavioral Health Commission aligns County of El Dorado with best practices being implemented throughout the State of California and also fulfills one of the prerequisites needed if the County opts into the Drug Medi-Cal Organized Delivery System waiver. 

 

The Commission made several additional changes to their Bylaws in an effort to align their Bylaws with their current operations. 

 

Changes in the Bylaws included a reorganization of the Commission from a model utilizing two councils (one on the East Slope with 6 members and one on the West Slope with 10 members), to a single Commission with 16 members.  Officers of the Commission will include the Chairperson, two Vice-Chairs, one from the West Slope and one from the East Slope, and a Secretary.  Technology improvements in video conferencing have made coordinated efforts between both slopes of the County practical and effective.  Additionally, the updated Bylaws clarify the roles of the commission officers and provide guidance related to conducting commission meetings.

 

Another change to the Bylaws includes the elimination of multiple committees that were largely unutilized, such as the planning and budget committee, the nominating committee, the children’s committee, the committee on aging and the legislative committee.  These committees can still be formed based on the language in the Bylaws related to establishing an Ad Hoc committee.   The Bylaws indicate an Ad Hoc committee can be established for a specific purpose such as budget review or reviewing children’s services outcomes.  This also coincides with the Commission current practice of using Ad Hoc committees.

 

The Behavioral Health Commission reviewed the changes to their bylaws on February 28, 2018 and adopted them March 28, 2018.

 

ALTERNATIVES:

Disapproval of the revised Bylaws will result in the Commission being out of compliance with State law and Commission operations.
