Surveyor's Office recommending the Board adopt and authorize the Chair to sign Resolution 087-2018 for Abandonment of Easement 18-005 to abandon the portion of the public utility easement on Lot 7 of "Tahoe Paradise Unit No. 18”, recorded at Book C of Subdivisions at Page 50, identified as Assessor's Parcel 034-402-13.

DEPARTMENT RECOMMENDATION

Surveyor's Office recommending the Board adopt a Resolution of Vacation for Abandonment of Easement (AOE) 18-005 to abandon the portion of the public utility easement located on the south half of Lot 7 of "Tahoe Paradise Unit No. 18", recorded at Book C of Subdivisions at Page 50, identified as Assessor's Parcel Number (APN) 034-402-13. This abandonment was requested by the owners, Warren L. Johnson and Patricia J. Johnson Revocable Living Trust and the Nancy King-Walter Trust.

 

DISCUSSION / BACKGROUND

A request has been submitted by Warren L. Johnson and Patricia J. Johnson Revocable Living Trust and the Nancy King-Walter Trust, owners of APN 034-402-13, requesting that the County of El Dorado, Board of Supervisors, vacate the portion of the public utility easement located on the subject property. Said easement is more particularly described in Exhibit A, and depicted on Exhibit B of the attached Resolution.

 

The public utility easement, as shown on Lot 7 of "Tahoe Paradise Unit No. 18", recorded at Book C of Subdivisions at Page 50 was offered to the County of El Dorado by, Tahoe Paradise Homes, a Corporation, on May 12, 1960. The easement was acknowledged and accepted by the County of El Dorado on July 5, 1960 and the Subdivision Map recorded on July 5, 1960.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 18-005. By utilizing this alternative, the owner of Assessor's Parcel 034-402-13, would be unable to purse any development that would impact this easement.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Southwest Gas Corporation, South Tahoe Public Utility District and Liberty Energy have not used said easement for the purpose for which it was dedicated and find no present or future need exists for subject easement and do not object to its vacation, and to that end, have all issued letters to that effect

 

CAO RECOMMENDATION

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no fiscal impact or Net County Cost associated with this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution to the Surveyor's Office for further processing.
