DISCUSSION / BACKGROUND:

The County of El Dorado is mandated by the State to have a Local Enforcement Agency (LEA) to oversee the enforcement of solid waste laws.  While the LEA is normally placed in county environmental health departments, El Dorado County Environmental Management is the operator of Union Mine Landfill, and faces a potential conflict of interest.  State law requires the County to staff the LEA with a full time environmental health specialist.  This requirement can be met by contracting with a neighboring jurisdiction with full time staff who have expertise in solid waste management.  This requirement is satisfied through an Agreement for Services with the County of Placer, which has been renewed sequentially since at least 2008.  The Agreement with County of Placer is partially funded by the annual grant from the California Department of Resources Recycling and Recovery (CalRecycle) and solid waste franchise fees collected by Environmental Management.

 

CalRecycle offers an LEA grant program to assist LEAs with the cost of solid waste permit and inspection programs.  The application requires that a resolution, effective for up to five years, and authorizing and identifying a signature authority be submitted with the annual on-line application.

 

ALTERNATIVES:

Should the Board decline to adopt this Resolution, HHSA would need to present to the Board annually the grant documents to execute, thereby delaying revenue for the solid waste program.  The CalRecycle grant processing time is short term, so delaying the process annually could jeopardize funding.

FINANCIAL IMPACT:

There is no Net County Cost associated with this Agenda item.  Sufficient appropriations were included in the fiscal year 2020-2021 budget, and will be included in future budget requests through fiscal year 2026-2027 in accordance with the attached Resolution
