Surveyor's Office recommending the Board adopt and authorize the Chair to sign Resolution 079-2020 for Abandonment of Easement 20-0001, to abandon a public utility easement on Lot 189 and 190 of Serrano Village K1 and K2 - Unit 5B, recorded in Book K of Subdivisions at Page 3, identified as Assessor's Parcel Number 123-660-016 and 123-660-017, within the community of El Dorado Hills, Supervisorial District 1.

DISCUSSION / BACKGROUND

A request has been submitted by James Russell Lawson and Janice Rae Lawson, husband and wife, as joint tenants, owners of Assessor's Parcel Number 123-660-016 and 123-660-017, requesting that the County of El Dorado, Board of Supervisors, vacate a public utility easement located on said properties. Subject easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution. 

 

The public utility easement, as shown on Lot 189 and 190 of Serrano Village K1 and K2 - Unit 5B, recorded in Book K of Subdivisions at Page 3, was offered to the County of El Dorado by Serrano Associates, LLC A Delaware Limited Liability Company, Parker Development Company, A California Corporation Managing Member, on September 15, 2016. The easement was acknowledged and accepted by the County of El Dorado on December 6, 2016, and the Subdivision Map was recorded on December 19, 2016.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 20-0001. By utilizing this alternative, the owner of Assessor's Parcel 123-660-016 and 123-660-017, would be unable to pursue any development that would impact subject easement.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District, and Pacific Gas & Electric have not used said portion of subject easement for the purpose for which it was dedicated and find no present or future need exists for said portion of subject easement and do not object to its vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION / COMMENTS

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

The Surveyor's Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
