Fiscal Impact/Change to Net County Cost:  Funding for the agreement has been included in the Department's FY 2009-10 budget.  No change to Net County cost.
 
Reason for Recommendation:
The Library is currently under contract with SirsiDynix to provide the software license and maintenance of the system used for circulation, acquisitions and cataloging of library materials.  
 
This new agreement continues the license and maintenance of the system.  The term of the agreement is for a period of three years and shall automatically renew each year thereafter unless terminated.  The Department will return in future years to request continued use of the contract prior to the automatic renewal date.  The contract was approved by County Counsel noting non-standard indemnity and limitation of liability, however the Library has received services from SirsiDynix since September 2002 without incident.  
 
Action to be taken following Board approval:
1.  Chairman to sign Agreement, Amendment and Long Term Maintenance documents.
2.  Board Clerk to return one fully executed original to the Library for distribution.
