Title

Department of Transportation recommending the Board adopt and authorize the Chair to sign Resolution 105-2020 authorizing the Director of Transportation to execute Program Supplemental Agreements, Federal Apportionment Exchange Program and State Match Program Agreements with the California Department of Transportation for Federal and/or State funded transportation projects.

DISCUSSION / BACKGROUND

The Department of Transportation (Transportation) is eligible to receive federal and/or state funding for certain transportation projects.  California Department of Transportation (Caltrans) requires Program Supplemental Agreements, Federal Apportionment Exchange Program and State Match Program Agreements to provide funding to the County for Federal and/or State funded transportation projects.  The County has been working collaboratively with Caltrans over the years to execute these types of agreements.  Recently, Caltrans informed Transportation staff that they are requiring a certified resolution that clearly identifies the representative who is authorized to sign for the County and also, the County is required to sign and return these agreements within two weeks.  Due to County processing timelines, Transportation is unable to meet this deadline through individual items for Board consideration and approval.  Therefore, Transportation is requesting the Board authorize the Director of Transportation to execute said agreements. 

 

The Chief Administrative Office, Community Development Services, Administration and Finance Division (CDS A&F) sent the Federal Apportionment Exchange and State Match Program Agreement X20-5925(179) (Agreement) that was approved by the Board on May 12th (Legistar 20-0517, Item 12) to Caltrans. Caltrans responded that they will not accept any funding agreements from Transportation without a Resolution in place. While working with County Counsel to draft the Resolution, it was decided to include the following language, "Be it further resolved, that the El Dorado County Board of Supervisors hereby ratifies any agreement executed by the Director of the Department of Transportation described in the previous resolved clause between the period of April 1, 2020, to the date of this Resolution" to allow Transportation the flexibility to sign the Agreement and send to Caltrans if necessary so Transportation doesn't risk losing funding in the amount of $459,164. To date, the Director of Transportation has not signed the Agreement and is waiting for the Board to approve this Resolution.

 

ALTERNATIVES

The Board could choose to not adopt the Resolution and Transportation will not be able to meet Caltrans' deadlines and therefore, may not be eligible for federal and/or state funding for certain transportation projects.

FINANCIAL IMPACT

There is no direct financial impact associated with the adoption of this agenda item. However, not adopting this Resolution could put Transportation's Federal and/or State funding in jeopardy.
