DISCUSSION / BACKGROUND
The Chief Administrative Office recommends the Board approve the budget transfer increasing appropriations in order to process the FY 2019-20 Superior Court Maintenance of Effort 50/50 revenue split expense as ordered by the State of California and to increase vehicle code and traffic fines budgeted revenue received by the Superior Court.

The purpose of the County’s Maintenance of Effort Budget is to provide the level of financial support to the State of California, as required by law, for the Superior Court of California, El Dorado County.

The required Superior Court Maintenance of Effort (MOE) is funded with the County’s share of the fine and fee revenue that the County receives. In addition to being responsible for a base MOE amount, the County is required to remit to the State a 50% portion of certain fine and fee revenue received in excess of this base amount. Due to higher than anticipated collections of these revenues in FY 2019-20, the appropriations need to be increase to remit the entire 50% portion of revenues to the State.

Since revenues were higher than budgeted, increasing the budgeted revenue amount by $50,000 will offset the increased appropriations.

ALTERNATIVES
The Board could choose to not approve the budget transfer, however, the department will not be able to issue the State ordered payment for FY 2019-20.
