District Attorney recommending the Board:
1) Disband the El Dorado County Indian Gaming Local Community Benefit Committee;
2) Authorize the return of remaining unspent grant funds, plus any accrued interest, to the California Gambling Control Commission in the total estimated amount of $65,658; and
3) Approve and authorize the Chair to sign FY 2020-21 budget transfer to increase appropriations by $65,658 under the Indian Gaming Special Revenue Fund for the payment of the unspent grant funds, plus any accrued interest. (4/5 vote required)

DISCUSSION / BACKGROUND
On April 12, 2011, the Board approved the County’s establishment and participation in an Indian Gaming Local Community Benefit Committee (“The Committee”), as defined by Government Code Section 12715. Per the code, funding uses shall be limited to the following priorities: law enforcement, fire services, emergency medical services, environmental impacts, water supplies, waste disposal, behavioral, health, planning and adjacent land uses, public health, roads, child care, recreation and youth programs that mitigate impacts from casinos on local jurisdictions.
Since the founding of The Committee, the County has been awarded $207,272.06 in grant funds from the State’s Indian Gaming Special Distribution Fund upon approval of periodic Request for Application (RFA) submissions and expended $147,617.29 in program activities. Total Remaining Funds: $59,654.77 + $6,003.31 (Est. Accrued Interest) = $65,658.08
As of August 2016, there have been no active expenditures of Indian Gaming Grant Funds by the County.
The District Attorney’s Office has confirmed the department does not foresee any remaining funds being allocated to support active law enforcement objectives. Based on this assessment, the District Attorney is recommending to disband The Committee and requests to return all unspent funds, plus accrued interest, to the California Gambling Control Commission.
ALTERNATIVES
Should the board opt not to disband The Committee and return unspent funds, interest will continue to accumulate.
