DISCUSSION / BACKGROUND

A request has been submitted by Miroslaw Majorek, trustee of the Miroslaw Majorek Survivor’s Trust dated November 21, 2017, owner of Assessor's Parcel Number 083-141-026, requesting that the County of El Dorado, Board of Supervisors, vacate public utility easements located on said property. Subject easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution. 

 

The public utility easements, as shown on Lots 173 & 174 of Air Park Estates And Resubdivision Of Lot 459 Of Cameron Park North Unit No. 1, recorded in Book D at Page 78, were offered to the County of El Dorado by Security Title Insurance Company a California corporation; First American Title Company Of Sacramento a corporation (formerly Bankers Title Guaranty Company, a corporation); First American Title Insurance & Trust Company a California corporation; and Dorado Estates a California corporation, on October 27, 1966. The easements were acknowledged by the County of El Dorado on February 17, 1967, and the Subdivision Map was recorded on February 14, 1967.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 20-0009. By utilizing this alternative, the owner of Assessor's Parcel 083-141-026, would be unable to pursue any development that would impact subject easement.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District, and Pacific Gas & Electric have not used said portions of subject easements for the purpose for which they were dedicated and find no present or future need exists for said portions of subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor”s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
