Background: On June 30th, 2009, the Environmental Management Department (EMD) brought forth an agenda item seeking direction concerning the Solid Waste Franchise Agreement of Franchise Area 4 (West Lake Tahoe Basin) that is currently set to expire December 31, 2009. The Board directed the EMD to enter into negotiations with Tahoe Truckee Sierra Disposal Inc., for a five year extension to the current Franchise Agreement.

Reason for Recommendation: The current Collection Franchise Agreement Between El Dorado County And Tahoe Truckee Sierra Disposal Co., Inc. includes a renewal of agreement provision “allowing the parties to engage in good faith negotiations for the purpose of agreeing on terms and conditions for the extension of this Franchise Agreement for a five year period, or for such longer period as the parties may agree”.

Pursuant to the Boards June 30, 2009 direction, EMD notified Tahoe Truckee Sierra Disposal Company of the County’s intent to enter into negotiations to extend the term of the existing franchise agreement with Tahoe Truckee Sierra Disposal by five (5) years to December 31, 2014.

Environmental Management and Tahoe Truckee Sierra Disposal have held several negotiation sessions wherein contract negotiation issues have been addressed.
