FUNDING:  Senate Bill 844 Grant Funding.

DISCUSSION / BACKGROUND

On September 19, 2017, the Board authorized grant money acceptance issued through the Senate Bill 844 Adult Local Criminal Justice Facilities Construction financing program.  $25,000,000 in funding was awarded to allow for much needed expansion at the Placerville Jail.

 

Since this time, the Division and respective State Departments/Divisions have worked through many regulatory revisions and requirements in efforts to complete necessary due diligence and other tasks.  Through this process, it was discovered three easements are in place on this County property, potentially involving the contiguous property owner Capital Consultants Inc., although the easements were not well defined.  Per the State Department of Finance, unless these exceptions are removed from the title report the Sate won’t release the bond funding.

 

Capital Consultants Inc. has agreed to relinquish these three easements via an easement quitclaim deed with no compensation.  Once executed, the documents will be recorded and an updated title report will be generated to the State to display these exceptions have been removed.

 

ALTERNATIVES

The Board could decline to execute the quitclaim deeds and the State will not release the grant funding.

FINANCIAL IMPACT

The estimated cost to cover staff time and recording fees is anticipated to be under $1,000. Funding is included in the FY 21/22 Accumulated Capital Outlay (ACO) budget.  There is no change in Net County Cost.
