Title

Surveyor's Office recommending the Board adopt and authorize the Chair to sign Resolution 148-2021 for Abandonment of Easement 21-0005, to abandon a portion of a Drainage and Public Utility easement on Lot 32 of Rolling Hills Estates Unit 1, recorded in Book I of Subdivisions at Page 11, identified as Assessor's Parcel Number 110-370-032.

DISCUSSION / BACKGROUND

A request has been submitted by Lindsey D. Jones, a married woman as her sole and separate property, owners of Assessor's Parcel Number 110-370-032, requesting that the County of El Dorado, Board of Supervisors, vacate a portion of the rear Drainage and Public Utility easement located on said property. The remaining portion of the easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution. Said property is within the community of El Dorado Hills, Supervisorial District 1. 

 

The Drainage and Public Utility easement, as shown on Lot 32 of Rolling Hills Estates Unit No. 1, recorded in Book I of Subdivisions at Page 11, was offered to the County of El Dorado by Pulte Home Corporation, A Michigan Corporation, on July 15, 1998.  The easement was acknowledged by the County of El Dorado on September 18, 1998, and the Subdivision Map was recorded on September 22, 1998.

 

ALTERNATIVES
An alternative would be to not adopt the Resolution of Vacation for Abandonment of Easement 21-0005. By utilizing this alternative, the owners of Assessor's Parcels 110-370-032 would be unable to pursue any development that would impact the subject easement.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

Department of Transportation, AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said portion of subject easement for the purpose for which it was dedicated and find no present or future need exists for said portion of subject easement and do not object to its vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor's Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
