Fiscal Impact/Change to Net County Cost:  No fiscal impact to County.
 
Background: On December 11, 2007 the Board of Supervisors supported implementation of the Electronic Recording Delivery System (ERDS) by passing Resolution #308-2007 authorizing the Recorder-Clerk to collect $1.00 per document fee for oversight and implementation of Electronic Recording.   
 
Reason for Recommendation: Since 2005 the Board has supported the MOU with the Department of Justice to prepare regulations and oversight of Electronic Recording Delivery Systems.  Regulations are prepared, vendors and security are being tested and certified by the office of the Attorney General.  This MOU provides CERTNA with assurance that we will be entering this new phase of recording in a matter of months.
 
Action to be taken following Board approval: Board to sign two copies of the MOU and return to department.
