Transportation Department recommending Chairman be authorized to sign a Grant Deed transferring fee simple title to the State of California for portions of certain parcels acquired for the U.S. Highway 50/Missouri Flat Interchange Project No. 71317.

Fiscal Impact/Change to Net County Cost:

There is no Fiscal Impact to the County, as the land rights have already been acquired and were part of the original project costs.

 

Background:

As part of the U.S. Highway 50/Missouri Flat Interchange Project #71317, the County and the State of California (State/Caltrans) entered into a cooperative agreement (District Agreement No. 03-0337, dated August 15, 2006). The agreement provided for the County to obtain the necessary right of way for the reconstruction of the entire Interchange, with those portions of the right of way for the new overcrossing and ramps ultimately being transferred from the County to the State.

 

The County has acquired all of the necessary land rights for the Interchange Project by negotiated settlements with all affected property owners. The County is now prepared to transfer portions of certain parcels to Caltrans.

 

Reason for Recommendation:

The Grant Deed and legal description have been prepared by the El Dorado County Department of Transportation, following the Caltrans required format for the Grant Deed, legal description and Notary Page/Certificate of Acceptance. Officials from Caltrans, and County Counsel's office, have reviewed and approved the documents and legal descriptions, as to form. It is now time to move forward with transferring those certain land rights from the County to the State, which is accomplished by the Board of Supervisors approving the Grant Deed, and the deed being executed by the Chairman of the Board.

 

Action to be taken following Board approval:

1) Chairman of the Board to execute the Grant Deed from El Dorado County to the State of California.

2) The Board Clerk shall attest to the Board Chairman's notarized signature, and return the original Grant Deed and legal description to the Department of Transportation for transmittal to Caltrans.
