Title

Chief Administrative Office recommending the Board authorize the Chairman to sign a Grant Deed with the State of California to complete the transfer of the Cameron Park Courthouse (APN: 083-020-39-100) to the State; receive and file update regarding Main Street Courthouse; and receive and file update from the Administrative Office of the Courts regarding potential new Placerville Courthouse.

Background:

Cameron Park Courthouse  - Senate Bill 1732 - Trial Court Facilities Legislation and subsequent Assembly Bill 1491 require all counties to transfer their court facilities to the State.  On November 18, 2008 (Agenda Item 53, File 08-1441) the Board signed a Transfer of Responsibility Agreement for the Cameron Park Courthouse as required by the above noted legislation.  The Cameron Park Courthouse transfer of Title could not be completed at that time because the Cameron Park Alternative Dispute Resolution building project was not yet completed. 

 

Main Street Courthouse - The Administrative Office of the Courts (AOC) requested and performed a Limited Phase II Environmental Investigation at the Main Street Courthouse.  The survey indicated that there may be underground issues associated with an old underground storage tank.   The letter from the AOC indicates that considering the age of the facility, existing environmental conditions at the site and the AOC's long term plan for building a new courthouse in Placerville, they do not want to proceed with transferring title to the building to the State. 

 

New Placerville Courthouse -   Information has been received by the County indicating that the plans for a new courthouse in Placerville are still moving forward.   The estimated timeframe for funding authorization from the State is late 2009; however, it is noted that the estimated authorization date is revenue dependent and subject to change.

 

Reason for Recommendation: 

Cameron Park Courthouse - On August 25, 2009, the Department of Transportation brought an agenda item (File 09-0928) to the Board recommending the Chairman be authorized to sign the Notice of Completion for the Cameron Park Courthouse Alternative Dispute Resolution Modular Building Project.  Since the project is now completed, the State has requested the Board authorize the Chairman to sign the Grant Deed in order to complete the title transfer for the Cameron Park Courthouse. 

 

Action to be taken following Board approval:  Chairman will sign the Grant Deed and forward to the Chief Administrative Office.  Grant Deed will be sent to the Court's Office of Court Construction and Management who will prepare the package for the State Public Works Board review.  Once the State Public Works Board completes their review, the Grant Deed will be recorded.
