Fiscal Impact/Change to Net County Cost: No federal asset forfeiture purchases or expenditures are currently planned.

Background: On 9/15/09 the District Attorney's Office brought forth the original version of the agreement for Board approval and signature. At that point in time the department was unaware that funds in the amount of $9,554.64 through federal asset forfeiture has been received by the county. It was upon notification by the Department of Justice funds that it was determined that the funds had inadvertantly been deposited in to the Sheriff's special revenue fund. Since that time a journal entry to reclass the revenues into the District Attorney's special revenue account has been processed.

Reason for Recommendation: This agenda is a revision to the one approved by the Board on September 15, 2009. Per the Equitable Sharing Agreement guidelines, the agreement must be submitted within 60 days of the end of the Agency's (County) fiscal year. Based on the recieipt of funds noted above, it is necessary for the Board to sign the attached revision in order for the District Attorney to continue to receive a share of federal asset forfeitures, if they become available, and use these funds according to the prescribed guidelines for law enforcement purposes.
