Department of Transportation recommending the Board authorize the Chair to sign Amendment 2 to Agreement CTA-04025 with the California Tahoe Conservancy for the Lake Tahoe Boulevard Erosion Control, Stream Environment Zone, and Bike Trail Projects. The Amendment will extend the life of Agreement CTA-04025.1 to June 30, 2011. There is no Fiscal Impact associated with this item.

Background:
On December 17, 2008 the Department of Transportation (Department) was notified by the State of California (State), via the California Tahoe Conservancy (CTC) that the State was freezing existing bonds effectively stopping or significantly slowing work on a number of State funded Environmental Improvement Program (EIP) Projects from December 17, 2008 to present. On July 9, 2009, the CTC notified the Department that the State Treasurer's Office freed up limited funds to cover existing unpaid bills with the remaining amount used to restart existing bond-funded projects. At that time, the CTC requested a restart funding strategy from the Department to account for the fact that the released funds are less than the full cost of the existing grants. The Department submitted the funding strategy to the CTC on August 19, 2009.
Agreement CTA-04025 was originally authorized by the CTC Board on May 20, 2005 for $252,000. Amendment 1 to Agreement CTA-04025 was authorized by the CTC Board on May 19, 2006 and increased the total grant amount by $103,000 to a total of $355,000. The expiration of this Agreement was amended to June 30, 2010.
Reason for Recommendation:
Amendment 2 of Agreement CTA-04025 will allow the Department to continue work on the Lake Tahoe Boulevard Projects and will reinstate $59,078.62 (as of February 26, 2010) in grant funds that would have expired June 30, 2010....
