Fiscal Impact/Change to Net County Cost:
There is no net cost to the County's General Fund associated with this agenda item.
 
Reason for Recommendation:
On July 1, 2010, the new National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water Discharges Associated with Construction and Land Disturbance Activities becomes effective.  In conjunction with the new permit, the State Water Resources Control Board (SWRCB) is implementing the new Storm Water Multi-Application and Report Tracking System (SMARTS).  A requirement of SMARTS is that the individual that submits and certifies all Permit Registration Documents (PRDs), Notice of Intent (NOI), Notice of Termination (NOT), and is responsible for reviewing, validating and certifying the annual storm water report before it is submitted to the SWRCB be a Legally Responsible Person (LRP).  
 
The SWRCB's definition of a LRP for a public agency is either a principal executive officer or ranking elected official.  Based on the definition of an LRP, the Department is recommending that the Director and the Deputy Directors be designated LRP's.  
 
Action to be taken following Board approval:
The Board Clerk will forward a certified minute order to the Department.
