Background: The federal government enacted P.L. 104-193, the Personal Opportunity and Work Responsibility Act of 1996, which prohibits legal immigrants from receiving Supplemental Security Income (SSI). The following year the federal government enacted the Balanced Budget Act of 1997 amending P.L. 104-193 to allow some, but not all, legal immigrants to receive SSI. In 1998 the California Legislature enacted AB 2779, Chapter 329, the Budget Act Implementation Bill for Social Services, known as the Cash Assistance Program for Immigrants (CAPI) which allows legal immigrants who are ineligible for SSI, due to their immigrant status, to receive cash assistance payments. The responsibility to administer CAPI is delegated to county welfare departments or a consortium of county welfare departments.

Reason for Recommendation: A consortium of county welfare departments, known as the North State/Orange CAPI Consortium (NSOCC), was formed in 1998 to provide participating counties with guidance and assistance in administering the CAPI program and providing mandated payments to eligible immigrants. El Dorado County Department of Human Services is a member of the NSOCC. Sacramento County is the overseeing entity of the consortium and develops the non-financial Memorandum of Agreement (MOA) with each participating county to facilitate understanding, conformity and accountability in regards to implementation of the CAPI program.
