Fiscal Impact/Change to Net County Cost:
There are no fees or assessments relative to this License Agreement CTC_20100921_El Dorado. There is no fiscal impact or net cost to the County General Fund associated with this agenda item.

Reason for Recommendation:
The Department of Transportation (Department) will begin construction as early as May 1, 2011 for the Montgomery Estates Area 1 Erosion Control Project (Project). The purpose of this License Agreement is to utilize three California Tahoe Conservancy (CTC) owned parcels (Assessor's Parcel Numbers 025-433-08, 025-594-01, and 025-621-03) for the purpose of treating storm water runoff from the County’s Right of Way within the Montgomery Estates Subdivision in order to meet the Tahoe Regional Planning Agency and State Water Quality Control Board - Lahontan Region Storm Water Program water quality goals.

Action to be taken following Board approval:
1. After the Board Chair signs the two (2) originals of the License Agreement, the Board Clerk will complete the All Purpose Notary Acknowledgement provided.
2. The Board Clerk will send both originals of the License Agreement and the All Purpose Notary Acknowledgement to the Department for processing to the CTC for signature.

Action to be taken by Department following Board approval:
1. Upon receipt from the CTC, the Department will send the signed original of the License Agreement to the Recorder/Clerk's office for recordation.
2. Following recordation, the Department will forward the fully-executed original to the Board Clerk's office.
