Background:
On October 6, 2009 the Board approved Lease Agreement 159-L1011 for the Department of Child Support Services. On March 23, 2010 Amendment I was approved to correct payment information.
 
Reason for Recommendation:
The intent of this amendment is to change who shall obtain and pay for the gas/electric utility invoices. The facility's main floor consists of 6,000 square feet, in which the Department of Child Support Services occupies 3,024 square feet, while another outside agency occupies the rest. The Department of Child Support Services was informed that they had been paying for the gas/electric utility for the entire 6,000 square feet.  This was an oversight and the Lessor was informed of this situation and has reimbursed the department for the amount owed.  The amended language is as follows:  Gas and/or electric utilities shall be obtained and paid for by Lessor; Lessee shall reimburse to Lessor within thirty days (30) days of receipt of itemized invoice provided by the Lessor.
 
Action to be taken following Board approval:
Upon approval by the Board, the Clerk of the Board will forward two (2) fully executed Amendment II to Lease Agreement 159-L1011 to the Property Services Unit, Facilities Engineering Division, Department of Transportation for distribution.
