Fiscal Impact/Change to Net County Cost:  No change.  Funding is 100% State General Fund allocation.  Funds are included in the Department's FY 2010-2011 Budget and will be included in the FY 2011-2012, FY 2012-2013 and FY 2013-2014 Budget Requests.  
 
Compensation for Services:  Payments to contractor are made within 45 days following the County's receipt and approval of itemized invoices.  Billing rate is $2,396 per month per participant, pro-rated for partial months.  Billing rates shall not exceed the cap rate established by the California Department of Social Services, which is 70% of the average group home rate.
 
Termination:  Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.
 
Background:  Transitional Housing Program-Plus (THP-Plus) is a State program created in 2001 to provide affordable housing and supportive services to homeless former foster youth to assist them in their continuing transition to independence.  Seventeen counties, including El Dorado County, have State-approved THP-Plus plans.  The Board approved the Department of Human Services (DHS) THP-Plus Plan on March 28, 2006 with an effective start date of July 1, 2006 set by the State.  The THP-Plus cap rate for El Dorado County was set at $2,934 by the State, but this rate may be negotiated lower by the County.  DHS is currently paying $2,920 per month per participant for THP-Plus services with a vendor located in Redding, California whose contract is set to expire June 30, 2011.
 
Reason for Recommendation:  Pursuant to the BOS and State-approved Transitional Housing-Plus Program Plan, El Dorado County Department of Human Services is responsible for the oversight of the administration and provision of THP-Plus services to certain emancipated foster youths and/or former dependents or wards of the juvenile court, ages 18-24 ("Youth").  DHS has negotiated a rate of $2,396 per month per participant with Whole Person Learning, Inc. (WPL) located in Auburn, CA.  WPL's THP-Plus plan has been certified by the State and complies with the requirements of the program.  
 
Due to WPL's close proximity to El Dorado County combined with their ability to more economically provide THP-Plus services, DHS recommends the County not renew the existing agreement with the THP-Plus vendor in Redding, CA and instead contract for THP-Plus services with WPL.  Agreement for Services 291-S1110 allows for WPL to provide THP-Plus services to Youth on an "as requested" basis by providing them with housing and supportive services while they acquire skills needed for independent living.  The contract will become effective upon execution and will be effective for three years.  The Agreement includes the County's standard "fiscal out" termination clause, as well as a provision for the County to terminate the agreement in seven calendar days upon written notice.
 
Purchasing Agent Recommendations:  The Purchasing Agent has determined that it is appropriate to dispense with a competitive selection process in order to continue with the needed services.  In accordance with Board of Supervisors Policy C-17, Section 7.4.1, the Purchasing Agent concurs with the department's request to contract with this independent contractor.
 
Action to be taken following Board approval:
1)  Chair to sign two originals of Agreement 291-S1110
2)  Board Clerk's Office to return one original Agreement to DHS at Briw Road
3)  Department to distribute as appropriate
