Within State gaming compacts with various Tribes, the State collects a percentage from gaming operations for the specific purpose of mitigating most any impact created by Indian Casinos.  Each jurisdiction affected by Indian Gaming is credited money annually that is additional from any other MOU.  
 
On April 12, 2011, (File #11-0381) the Board of Supervisors approved the both the establishment of and the Board's participation in an Indian Gaming Local Community Benefit Committee.  The Board then approved the appointment of Supervisors Briggs and Sweeney to this Committee.
 
The County of El Dorado has been appropriated $51,593.68 from the Indian Gaming Special Distribution Funds to be distributed by the Indian Gaming Local Community Benefit Committee pursuant to the application policies and procedures defined within State Government Code Section 12715 (g).
 
The City of Placerville has appointed City Councilwoman Wendy Mattson, and the Shingle Springs Band of Miwok Indians has appointed Kim Stock and Sam Daniels, respectively, as their representatives to the Committee.
 
The applicable state code sections are as follows:
 
Government Code Section 12715 (b)(1) provides direction for the establishment of Indian Gaming Local Community Benefit Committees ("The Committee") to select proposals to receive grant funds from the Indian Gaming Special Distribution Fund.  The Government Code establishes application policies and procedures for the grant selection process; specified priorities and requirements for funding eligibility; and the composition of The Committee.
 
Government Code Section 12012.85 created in the State Treasury the Indian Gaming Special Distribution Fund for the receipt and deposit of moneys received by the state from Indian tribes pursuant to the terms of tribal-state gaming compacts.  These moneys are to be appropriated by the State Legislature for purposes that include grant funding for programs designed to address gambling addiction, and grant funding for the support of state and local government agencies impacted by tribal government gaming.
 
Beginning with Section 12710, the Government Code provides for the methods to calculate the distribution of appropriations from the Indian Gaming Special Distribution Fund for grants to local government agencies impacted by tribal gaming.
 
Composition of The Committee is as follows:  two representatives from the County selected by the County Board of Supervisors; one elected representative from the City of Placerville, appointed by the Board of Supervisors; and two representatives selected upon the recommendation of a majority of the Shingle Springs Band of Miwok Indians.
 
The following uses shall be the priorities for the receipt of grant moneys:  law enforcement, fire services, emergency medical services, environmental impacts, water supplies, waste disposal, behavioral, health, planning and adjacent land uses, public health, roads, child care, recreation and youth programs that mitigate impacts from casinos on local jurisdictions.
