Fiscal Impact/Change to Net County Cost:

The Tahoe Engineering Unit of the Department of Transportation (Department) budgeted $60,000 and the Engineering Division budgeted $55,000 for use of this Agreement in Fiscal Year (FY) 11/12.  The Tahoe Engineering Unit anticipates budgeting $140,000 and the Engineering Division anticipates budgeting $145,000 in subsequent FYs - FY 12/13, FY 13/14 and FY 14/15.  Funding will be provided by California Tahoe Conservancy (CTC) and United States Forest Service Grant Funds, Tahoe Regional Planning Agency Mitigation Funds, the Road Fund and various Capital Improvement Program (CIP) funding sources that fund the Department’s CIP projects.

 

Reason for Recommendation:

In the Tahoe Basin, the Department's erosion control projects (ECP), funded in part by grants from the CTC, include revegetation and drainage improvement work to stabilize eroding slopes and drainage channels.  CTC grant guidelines require the inclusion of California Conservation Corps (CCC) labor and other cost-saving measures to be used on the projects.  The Department has contracted with the CCC to provide very flexible and cost effective labor for over sixteen years for ECPs that enhance and maintain environmentally sensitive lands and waters.

 

Under this Agreement the CCC will perform revegetation efforts, drainage improvement work, and repair on various ECPs in the Tahoe Basin.  In addition, the Agreement will also be used for tree and brush removal, tree trimming, and tree and shrub planting as noise mitigation on various West Slope CIP projects.

 

Since the term of the Agreement exceeds three years, the Department is seeking Board approval to dispense with the term requirements of Policy Number C-17 and allow a 3.5 year term for this Agreement for the following reasons: a) the CCC agreed to use a fixed labor rate throughout the term of the Agreement thereby providing cost savings to the County; and b) the expiration of the Agreement in the off-season is preferable as construction project workloads are reduced and CCC crews are typically not needed.

 

Pursuant to Article II, Section 210 b (6) of the El Dorado County Charter, the County may enter into any contract or agreement in cases where the Agreement is with or among any other governmental entities or agencies.

 

This Agreement is for labor associated with the construction of a public work, and as such, is not for professional services.  It is therefore exempt from Government Code Section 31000 regarding contracting for professional services and Human Resources and Employee Association notification are not required.  The Agreement is for labor only and is covered under the exception set forth in Section 20395(b) of the Public Contract Code exempting competitive bidding.  Section 20395(b) authorizes the direct contracting for labor only.

 

Action to be taken following Board approval:

1. The Chair will sign the two originals of the Sponsor Agreement, Project Evaluation and Agreement Addendum.

2. The Board Clerk will return the two partially executed original sets to the Department for further processing.

 

Action to be taken by the Department following Board approval:

1.  Upon receipt the Department will forward the partially executed originals to the CCC for signature.

2.  Upon receipt of the fully executed original from the CCC the Department will forward it to the Board Clerk’s office and retain a copy for its files.
