Fiscal Impact/Change to Net County Cost:
The cost of the Permit is included in the Department of Transportation’s (Department) Fiscal Year 2010/2011 Budget and the adopted 2010 Capital Improvement Program (CIP). The budgeted amount of $1,000 is only for the payment to the California Department of Parks and Recreation (State) for the processing of the Permit.

Reason for Recommendation:
The Department is currently in the Right-of-Way and Design phases of the Sawmill 2 Bike Path and Erosion Control Project (Project) and requires the Permit from the State in order to enter and construct the bike path and erosion control improvements on State owned parcels (Assessor's Parcel Numbers 033-020-03, 033-080-07, and 033-090-15). Furthermore, this Permit provides the Department written documentation to secure the right-of-way on this portion of the Project, which is required in order to obtain an approved right-of-way certification from Caltrans related to the Congestion Mitigation and Air Quality Improvement (CMAQ) Program construction funds approval process.

Action to be taken by the Department following Board approval:
1. Director of Transportation will sign three originals.
2. Department will forward one fully executed original to the Board Clerk for their records.
