Fiscal Impact/Change to Net County Cost:  No change.  There are no costs associated with the approval of this Plan.
 
Background: The Department of Human Services (Department) receives California Department of Housing and Community Development (HCD) Community Development Block Grant (CDBG) program funding for the provision of the housing rehabilitation loan program.  HCD requires that the housing rehabilitation program guidelines include a Residential Anti-Displacement and Relocation Plan (Plan) that must be reviewed and approved by both HCD and the County.  HCD has approved the Plan included in the program guidelines pending a public hearing and resolution from the Board of Supervisors.
 
Reason for Recommendation:  The Housing and Community Development Act of 1974, as amended, and the National Affordable Housing Act of 1990, require all grantees of CDBG or HOME Investment Partnerships (HOME) funds to follow a written Plan for any activities that could lead to displacement of occupants of property receiving funds from these or other federal funding source.  
 
Having been developed in response to the aforementioned federal legislation, this Plan is intended to inform the public of the County's compliance with the requirements of Federal Regulations 24 CFR 570.606 under state recipient requirements, Section 104(d) of the Housing and Community Development Act of 1974, 24 CFR Part 92 of the HOME Federal Regulations and 49 CFR Part 24, Uniform Relocation Assistance and Real Property Acquisition Regulations Final Rule and Notice (URA) dated January 4, 2005.  The Plan outlines reasonable steps that the County will take to minimize displacement and ensure compliance with all applicable federal and state relocation requirements.  
 
The latest language provided by the California CDBG program in the CDBG Grant Management Manual, Chapter 6, Relocation and Acquisition, has been incorporated into the Plan and is attached, displaying crossed out text as deletions and underlined text as additions.   
 
The Plan has always been incorporated into the Housing Rehabilitation Loan Program Guidelines, however, HUD Information Bulletin (Issue Number CPD-2010-02) dated November 30, 2009, reminds grantees that compliance with Section 104(d) of the Housing Community Development Act of 1974 (Section 104(d)-Regulations at 24 CFR Part 42) requires a grantee certify that they will comply with Section 104(d) and that they are following a Residential Anti-Displacement and Relocation Assistance Plan.  HCD requires the certification to take the form of a resolution following a public hearing.
 
Action to be taken following Board approval:  Board Clerk to provide Human Services with three (3) certified resolutions signed by the Chair.
